O ministro do Superior Tribunal de Justiça (STJ) Antonio Carlos Ferreira abriu prazo de 15 dias para que entidades representativas de condomínios e instituições financeiras se habilitem para intervir, como amici curiae, em recurso especial que discute a possibilidade de penhora de imóvel com alienação fiduciária na execução de débitos condominiais.
Segundo o relator, a intervenção dos amici curiae se justifica porque o recurso discute questão relevante de direito, com grande repercussão social. O julgamento, contudo, não será realizado sob o rito dos recursos repetitivos.
No caso em debate, o condomínio recorreu de decisão que, na ação de execução, negou seu pedido para que fosse penhorado um imóvel alienado em garantia à Caixa Econômica Federal (CEF) – permitindo, contudo, a penhora dos direitos do devedor.
O Tribunal de Justiça de São Paulo (TJSP) reformou a decisão por entender que, tendo em vista o caráter propter rem das obrigações condominiais (obrigações que seguem o bem, independentemente de quem seja o dono), a penhora poderia recair sobre o imóvel que gerou a dívida, mesmo estando em alienação fiduciária.
No recurso especial, a CEF alega que não seria possível a penhora do imóvel neste momento, porque não há título executivo contra a instituição financeira, que é a credora fiduciária e proprietária do imóvel.
