Falta de quórum e interpretação equivocada de norma.
A 35ª Câmara de Direito Privado do Tribunal de Justiça de São Paulo declarou inválida deliberação de condomínio que proibiu fumo em áreas comuns totalmente abertas por inobservância ao quórum qualificado de 2/3 dos condôminos. O colegiado também afastou advertência a morador pela prática e determinou que a administração do prédio se abstenha de aplicar sanções ao autor com fundamento exclusivo na interpretação ampliativa da legislação antifumo.
De acordo com os autos, o requerido é proprietário de imóvel e recebeu advertência por suposta violação da regra aprovada em assembleia que proibiu o fumo em qualquer área comum, com base na Lei Estadual nº 13.541/09.
